JMM-Mobiliário, Lda. is the legitimate owner of the “formati unique forms” brand, hereinafter referred to as “FORMATI”, and considers it essential to respect the privacy and protection of personal data provided to it, as the person responsible for its processing.

The processing of your data is necessary for the fulfilment of the contract of sale or provision of services to be concluded between you and JMM, or to carry out pre-contractual steps at your request.

Within the scope of customer data management, the personal data collected will be passed on to third parties that are freight transport companies for the sole and exclusive purpose of carrying out and fully executing the services or products purchased by the user, the owner of the personal data collected.

Some sections and/or functionalities of this website can be navigated without divulging any personal information on the part of the user.

Scope of the Privacy Policy

This Privacy Policy applies to data that has been directly provided by the data subject or collected when the data subject accesses our website, such as name, profession, telephone number, e-mail address, address, postcode and country.

Personal data and the purposes for which it is processed

Personal data is information relating to an identified or identifiable person. An identifiable person is one who can be identified directly or indirectly. Personal data is also the set of distinct pieces of information that can lead to the identification of a specific person.

JMM only collects the following personal data: name, profession, telephone contact, e-mail address, address, postcode and country and cookies.

JMM collects your data for the following purposes:

- For direct marketing or advertising, to be carried out by the data controller, i.e. to establish direct contact between the company and a customer in order to promote the brand and its products to the defined target audience, namely through the use of automatic calling machines, fax machines or electronic mail, including SMS, EMS and MMS, as well as to achieve a personalised relationship with customers, in order to know them well enough to be able to offer each category the most appropriate goods and services, with their consent as the legal basis;

- For the supply of products and/or services in fulfilment of the contract of sale or provision of services to be entered into between you and JMM, or to carry out pre-contractual steps at your request.

Personal Data Retention Period

The personal data collected through the website will be kept for a period of 5 years, without waiving the minimum period provided for by law depending on the purposes of the processing. In the absence of a legal requirement, the personal data will be kept for the minimum period strictly necessary for the purposes for which it was collected or subsequently processed, after which the data will be permanently deleted.

Rights of Data Subjects
As the holder of personal data, you have the right to request access to personal data concerning you, the rectification of personal data that is inaccurate or incomplete, the erasure of personal data, the total or partial restriction of the processing of personal data, the right to object to processing and the right to the portability of personal data in a structured, commonly used and machine-readable format.
Right of access
The holder of the personal data has the right to obtain confirmation from JMM as to whether or not the data concerning him/her is being processed and, where appropriate, to access his/her personal data and access the information provided for by law. If you want more than one copy of your personal data being processed, JMM may subject this service to a fee for administrative costs.
Right to rectification
The holder of the personal data has the right to obtain from JMM, without undue delay, the rectification of inaccurate or incomplete data concerning him/her.
Right to erasure of data (“right to be forgotten”)

The holder of the personal data has the right to ask JMM to delete his/her data without undue delay, JMM has the obligation to delete the personal data when one of the following reasons applies:

a) The personal data is no longer necessary for the purpose for which it was collected or processed;

b) The data subject has withdrawn their consent to the processing of data (in cases where processing is based on consent) and there is no other basis for said processing;

c) The data subject objects to the processing and there are no overriding legitimate interests justifying the processing.

Right to restriction of treatment

The data subject has the right to obtain from JMM the restriction of processing if one of the following situations applies:

a) Challenge the accuracy of personal data for a period that allows JMM to verify its accuracy;

b) The data processing is lawful and the data subject opposes the erasure of his or her personal data and requests, instead, the restriction of its use;

c) JMM no longer needs the personal data for processing purposes, but such data is required by the data subject for the purposes of declaring, exercising or defending a right in legal proceedings;

d) has objected to the processing, until it is established that the legitimate reasons of the controller prevail over those of the data subject.

Right to data portability

If the processing depends on the consent of the data subject and that consent has been given by automated means, the data subject has the right to receive the personal data concerning him/her that he/she has provided to JMM in a structured, commonly used and machine-readable format.

Right to object

In cases where the processing of data is carried out for the purposes of the legitimate interests pursued by JMM; or the processing of data is carried out for the purposes of direct marketing; or profiling, the data subject may at any time object to the processing of their personal data.

Breach of Personal Data
In the event of a personal data breach, the controller shall notify the supervisory body without undue delay and, where possible, within 72 hours of becoming aware of it, unless the personal data breach is not likely to result in a risk to the rights and guarantees of natural persons.
